These terms of service govern your use of the Site, whether you are a “member” (you have registered and posted content on the Site including but not limited to forums, personal pages or blogs), a “subscriber” (you have signed up to receive our mailing list or a “visitor” (you simply browse the Site) and govern all Services provided to you by Savvy Fashionista in connection with SavvyFashionista.co.uk.

We make no warranty or representation that SavvyFashionista.co.uk (or any element of it) is appropriate or available for use in locations outside the United Kingdom. Savvy Fashionista may modify or discontinue the Site at any time with or without notice to you and without liability to you or any third party. We reserve the right to terminate this Agreement at our election and for any reason, without prior notice, and this Agreement will automatically terminate in the event that You violate any of the terms set forth below. In the event of any termination, You will immediately cease access to the Site and Services.
Registration and Your Account
Most areas of SavvyFashionista.co.uk may be viewed by all “visitors”, however registration is required in order to access some areas of the Site and in order to publish Content on the Site. You can register directly with us or by allowing the Savvy Fashionista application to work on your Facebook account.
When you register as a “member” on Savvy Fashionista, you are stating that you are over 18 years of age or are over 16 years of age with parent consent to use the Services. By registering, you represent and warrant that you have the right, authority, and capacity to enter into and to fully abide by all of the terms and conditions of this Agreement.
You agree to provide only accurate and complete information upon registration or at any other time and You will ensure that this information is kept accurate and up-to-date. Savvy Fashionista reserves the right to terminate your membership and access to any specific content if we learn that you have provided false or misleading registration information.
Access to the Site is not authorised for any other person or entity using your registration information and You are responsible for preventing such unauthorised use. Savvy Fashionista relies on usernames to know whether users accessing the Site and using our Services are authorised to do so. If someone accesses our Site using a your username, we will rely on that username and will assume that it is really You who is accessing the Site. You are solely responsible for any and all access to the Site or use of the Service by persons using your username. Please notify us immediately if You become aware that your username is being used without authorization.

We do not have control over websites that Savvy Fashionista may link to. Savvy Fashionista may contain links to third party websites that are not owned, operated, or controlled by Savvy Fashionista. Therefore, we cannot and do not assume responsibility for the content, privacy policies, quality, functionality or legality of such websites, the companies that own them or any goods or services available from such sites.
All matters concerning any goods and services that you purchase from a third party site, including without limitation all contract terms are solely between you and the owner of that site and Savvy Fashionista will not be liable for any costs or damages to you or any third party arising directly or indirectly out of any third party website. By using Savvy Fashionista you expressly relieve us from any and all liability arising from your use of any third party website.
Subject to the terms of our Privacy Policy, we may occasionally send email messages to you on behalf of third parties (“Merchants”) containing advertisements, promotions, etc. Savvy Fashionista makes no representation or warranty with respect to the content of these email messages or any goods or services which may be obtained from such third parties as a consequence of these emails, and you agree that Savvy Fashionista shall have no liability with respect thereto. Merchants and other advertisers are responsible for ensuring that advertisements and other materials submitted for inclusion on the Site are accurate and comply with applicable laws.

Savvy Fashionista does not read every message or comment posted on the Site, including community forums, personal pages, or blogs, and as such, we do not guarantee the accuracy, integrity or quality of such content. The views expressed in the community section of the Site including forums and personal blogs are not those of Savvy Fashionista.
While we require all users of SavvyFashionista.co.uk to comply with these Terms of Service, you understand that by using the Site, it is possible that you may be exposed to content that is offensive or objectionable. If you see something that you believe violates our policies please report it to us immediately using the ‘Report’ link on the page or contact us.
You acknowledge that you are solely responsible for the activity that occurs while signed into or while using Savvy Fashionista. You alone are responsible for the content of your messages and blog posts, your use of SavvyFashionista.co.uk and the consequences of any such messages and posts.
You are permitted to use Savvy Fashionista, only if You agree to comply with the following guidelines:

(9) You may not post to SavvyFashionista.co.uk or use SavvyFashionista.co.uk to publish, send or distribute any message or material (in any media or form) that infringes the copyright, trademark, trade secret, or other intellectual property or proprietary right of others, is unlawful, defamatory, discriminatory, libelous, abusive, threatening, harassing, hateful, pornographic, obscene, inaccurate or encourages or engages in conduct that could constitute a criminal offence, give rise to civil liability, violate any applicable local, national or international law or regulation, or is otherwise inappropriate, as determined by Savvy Fashionista in its sole discretion.
(10) You must not impersonate any other person or entity, whether actual or fictitious.
(11) You will not harass or advocate harassment of another person on any part of the Site. In addition, you will not use any information obtained from Savvy Fashionista to harass, abuse, or harm another person.
(12) You must not use any automated use of the system, such as using scripts to add friends or send messages.
(13) You must not use SavvyFashionista.co.uk or any part of SavvyFashionista.co.uk in a way that might interfere with, disrupt, damage or create an undue burden on the Site, jeopardise the correct functioning of the Site, or otherwise attempt to derive the source code of the software (including the tools, methods, processes, and infrastructure) that enables or underlies the Site.
(14) You must not upload or transmit any form of virus, worm, Trojan horse, or other malicious code.
(15) You must not sell or otherwise transfer your profile, without our permission.
Materials submitted to Savvy Fashionista will not be returned to the submitting party and Savvy Fashionista has no obligation to inform you of any decision to remove or not post such materials.
Intellectual Property and Content Posted
SavvyFashionista.co.uk contains a number of areas through which you will be able to submit text, files, images, photos, works of authorship, or any other materials (collectively, “Content”). We do not claim ownership of any Content that you post to your personal blog on SavvyFashionista.co.uk. After posting your Content to your personal blog, you continue to retain all ownership rights as well as the right to use such Content in any way you choose.
By displaying or publishing (“posting”) any Content on or through the Savvy Fashionista Services, you (a) grant to us and our affiliates, representatives, and assigns an irrevocable, perpetual, non-exclusive, royalty-free, worldwide, transferable license (with the right to sublicense through multiple tiers) to use, reproduce, prepare derivative works of, distribute, adapt, publish, translate, publicly display, transmit or otherwise dispose of your Content (in whole or in part, alone or together with other materials) in any format or medium now known or later developed, including without limitation for advertising and promotional purposes, (b) warrant that you have the right to grant the foregoing rights to us, (c) agree that we have no obligation to compensate you for your Content or to exercise any of the foregoing rights and that any such exercise shall be in our sole and absolute discretion, (d) warrant that your Content does not solicit funds, or advertise or solicit goods or services, (e) agree that we may, and may authorize others to, identify and credit you as the author of your Content and use your name and pertinent biographical data in connection therewith, and (f) agree to indemnify and hold us harmless from any and all loss, damage, and/or expense (including reasonable solicitors’ fees) that we may suffer arising from or related to the exercise by us of the foregoing rights or the breach or alleged breach by you of any of the foregoing warranties by.
You affirm that you own or have the necessary licenses, rights, permissions, and consents to use any and all Content posted by you on SavvyFashionista.co.uk or otherwise have the right to grant the license set forth in this section, and that the posting of your Content on the Site does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to SavvyFashionista.co.uk.
Savvy Fashionista Services contain Content of Savvy Fashionista (“Savvy Fashionista Content”). Savvy Fashionista Content is protected by copyright, trademark, patent, trade secret and other laws, and Savvy Fashionista owns and retains all rights in the Savvy Fashionista Content and the Savvy Fashionista Services. Savvy Fashionista hereby grants you a limited, revocable, non-sublicensable license to reproduce and display the Savvy Fashionista Content (excluding any software code) solely for your personal use in connection with viewing the Site and using the Services.
The Savvy Fashionista Services contain Content of Users and other Savvy Fashionista licensors. Except for any such Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Services.
Savvy Fashionista reserves the right in its absolute discretion at any time to edit, alter, delete or move any Content posted to, appearing on or distributed by SavvyFashionista.co.uk and you. We reserve the right to remove any and/or all of your Content, and terminate your account with or without prior notice. You remain solely responsible for your Content whether or not we reject, modify or remove it. Savvy Fashionista will not enter into any discussions about its decision to edit, alter, delete or move such material.
Savvy Fashionista does not necessarily endorse, support, sanction, encourage, verify or agree with the comments, opinions or statements posted by users anywhere on the Site. Any information or material placed online by users, including advice and opinions, is the view and responsibility of those users and does not necessarily represent the view of Savvy Fashionista. If we highlight any particular Content in any area of the Site, any promotional materials or otherwise, such conduct is not intended as, and should not be deemed to be, an endorsement by us of such Content.
Non-Confidentiality and Security
You understand that information that You submit to us, such as Content and your preferences, is submitted precisely for the purpose of disclosure in a variety of media and channels, and therefore such information is not subject to any confidentiality obligation.
Savvy Fashionista will use reasonable efforts to maintain the security and integrity of information You provide to us. However, You acknowledge and agree that Savvy Fashionista cannot fully eliminate security risks and cannot guarantee that unauthorized access to Your information will never occur.
Disclaimer of Warranties
You agree that your use of and participation in SavvyFashionista.co.uk is at your sole risk. To the fullest extent permitted by law, Savvy Fashionista disclaims all warranties or representations of any kind, express or implied in connection with the Site and your use thereof and access is provided on an “as is” and “as available” basis.

All information on SavvyFashionista.co.uk is provided on the basis that neither Savvy Fashionista, or its Members, are engaged in rendering legal, medical, counselling or other professional services or advice. Savvy Fashionista advises you to seek appropriate professional advice or care for any situation or problem which you may have.
Savvy Fashionista shall not be responsible for any loss or damage caused directly or indirectly, by the information or ideas contained, suggested or referenced on SavvyFashionista.co.uk. No advice or information, whether oral or written, obtained by you from Savvy Fashionista or through SavvyFashionista.co.uk shall create any warranty not expressly made in these terms of service or imposed by law.
Limitations of Liability
You acknowledge and agree that we are only willing to provide access to the Site and to provide the services if you agree to certain limitations of our liability to you and to third parties. In no event shall Savvy Fashionista be liable for any direct, indirect, incidental, special, punitive or consequential losses or damages whatsoever resulting from any (a) errors, mistakes, inaccuracies or omissions or for the results obtained from the use of such information, (b) personal injury or property damage, or any nature whatsoever, resulting from your access to and use of our Site, (c) unauthorised access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (d) interruption or cessation of transmission to or from our Site, (e) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our Site by any third party.
Savvy Fashionista will not be liable for any such losses or damages regardless of the nature of any claim, whether based on warranty, contract, tort or any other legal or equitable theory, and regardless of whether any such losses or damages arise in the normal course of events or whether Savvy Fashionista has been advised of the possibility of such damages.
The foregoing limitation of liability shall apply to the fullest extent permitted by law. You acknowledge that Savvy Fashionista shall not be liable for user submissions or the defamatory, offensive or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you. We reserve the right, but have no obligation to monitor, or take any action that we deem appropriate regarding disputes that You may have with other Members.
You agree that your sole remedy for any claims arising in connection with this agreement is to discontinue your use of the Site and Services. In the event that a court determines that the preceding sentence is unenforceable, the aggregate liability of Savvy Fashionista to you for all claims rising in connection with this agreement will not exceed fifty pounds (GBP 50.00).
Indemnification
You agree to defend, indemnify and hold harmless Savvy Fashionista from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses including reasonable attorneys’ fees arising from your use of and access to Savvy Fashionista, your violation of any term of these Terms of Service, your violation of any third party right, including without limitation any copyright, property, or privacy right, or any claim that one of your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of Savvy Fashionista.
Competitions
From time to time Savvy Fashionista may run competitions, free prize draws and special promotions on this Site. Competitions are open to UK residents only, and entrants must be over 18 years of age. The winner(s) are announced within 7 days of the competition ending and will be contacted through the Site. The prize must be claimed within the next 7 days or else it shall be forfeited and another winner may be chosen. There will be no alternative, cash or otherwise, to the stated prize. Addition rules may be posted on the Site in or near the description of each Promotion. We reserve the right to interpret these rules and you agree to be bound by our interpretations.
